Child Pornography Laws in Kentucky
It is illegal to possess, distribute or produce content involving a minor under 18 years old engaging in sexual acts. For the sake of defining the elements of this crime, “sexual conduct” includes acts not limited to: masturbation, homosexuality, lesbianism, bestiality, sexual intercourse or deviant sexual intercourse. “Private erotic matter” refers to an obscene visual image, including a photograph, film, video recording, or digital reproduction, of an identifiable person, depicting sexual conduct or the exposure of uncovered human genitals, buttocks or nipple of the female breast.
You may be found guilty of possessing child pornography if you do any of the following acts involving an actual sexual performance by a minor:
- Knowingly possess or control any matter which visually depicts an actual sexual performance by a minor; or
- intentionally view any matter which visually depicts an actual sexual performance by a minor person.
If convicted, you may be punished as such:
- Class D felony
You may be found guilty of distributing child pornography if you do any of the following acts involving any matter portraying a sexual performance by a minor:
- Knowingly, or have reasonable cause to, send or cause to be sent into Kentucky for sale or distribution; or
- bring or causes to be brought into this state for sale or distribution; or
- exhibit for profit or gain; or
- distribute; or
- offer to distribute; or
- have in your possession with intent to distribute, exhibit for profit/gain or offer to distribute.
If convicted, you may be punished as such:
- Class D felony for the first offense
- Class C felony for each subsequent offense
You may be found guilty of producing child pornography if you do any of the following performances involving sexual conduct by a minor:
- Produce, direct or promote
If convicted, you may be punished as such:
- Class C felony if the minor involved in the sexual performance is under 18 at the time of the alleged offense
- Class B felony if the minor involved in the sexual performance is less than 16 at the time of the alleged offense
- Class A felony if the minor involved in the alleged offense is injured
