Degrees of Drug Trafficking
Drug crime penalties usually vary depending on the degree, type of drug, amount of drugs, a defendant's prior criminal history, and other mitigating or aggravating factors involved in the alleged crime.
- First Degree Trafficking:
Examples of crimes include the trafficking of 4+ grams of cocaine; 2+ grams of heroin, fentanyl, or meth; and 10+ units of a narcotic drug in in Schedules I or II. - Second Degree Trafficking:
Examples of crimes include the trafficking of 10+ dosage units of a drug in Schedules I or II that is not a narcotic drug or 20+ units of a Schedule III drug. - Third Degree Trafficking:
Examples of crimes include the trafficking of a drug in Schedules IV or V.
